Densmore Service Plans Terms and Conditions

The information below outlines the terms, conditions, and limitations that apply to Densmore Oil’s service plans.


This service plan is only available to customers whose primary fuel source is oil and purchase all of their fuel from Densmore during the terms of this service plan. New customers must be enrolled in automatic delivery. Please note: All systems that include an air conditioning or heat pump function will be billed at air conditioning service rates (regardless of whether it is being used for heating or cooling). 

  1. All service plans are effective April 1–March 31 each year. These plans automatically terminate if the customer no longer purchases all of their heating oil from the Company. Additional termination fees may apply. No credit will be issued if the plan is canceled before the expiration date. 
  2. Plan B and TankSure®must be paid for in full prior to use on account, or plan will be null and void. 
  3. Repairs or services not covered by the plans will be performed and charged to the customer at prevailing rates.
  4. Service plans do not cover the installation or replacement of parts provided by a customer.
  5. 1-hour minimum for all service calls. An additional after-hours fee will be charged to all service-related calls outside of regular hours, unless the service plan notes otherwise. 
  6. Service plans must be purchased prior to the start of any work. 
  7. The Company will pay up to $2,000 toward the replacement of your tank, once tested and qualified for the TankSure® Tank Replacement Program, if a tank leak occurs subsequent to this test due to internal corrosion, if a tank leak occurs due to a manufacturer’s defect, or if a non-leaking tank is identified for proactive replacement. While we cannot guarantee that a leak will not occur or your tank will not fail after testing, we are providing these new services with the hope that by testing and monitoring, we are offering a long-term proactive tank replacement program for our customers. Accidental damage is not covered by the TankSure® Tank Replacement Program. The TankSure® Tank Replacement Program does not cover environmental cleanup, property damage, waste disposal services, or other damages or losses caused by a tank leak or system failure, even if the tank has been tested and qualified ultrasonically and is enrolled in the TankSure® Tank Replacement Program. This does not cover replacement of piping without replacing the tank. 
  8. The service plan does not cover labor or materials to repair damage to the heating system or residence caused by the customer’s neglect, including but not limited to failure tohave sufficient fuel oil in the tank, insufficient water for boiler, blown fuses, or other failure of electrical system improper thermostat settings or faulty thermostat, having heating system switches in the “OFF” position, debris buildup in the air or venting systems, and other causes related to the improper operation or service of the heating system by the customer. Damage, repairs, or replacement of parts or components caused by acts of God, fire, flood, freezing, storm or weather conditions, power loss or surges, water damage, and fuel flow problems due to outside fuel storage are not covered by the plan. 
  9. The Company will provide service as soon as practical, during regular business hours under normal conditions or on an emergency basis, if necessary. The Company will not be liable for any damages arising from a delay or failure to provide service due to conditions beyond its control such as acts of God; labor disturbances or strikes; unavailability of mechanics or parts; failure or interruption of customer’s electricity; inaccessibility of the heating system; storms, floods, or other severe weather conditions; or government laws or regulations. 
  10. Customer agrees to release and hold Company harmless from all claims related to losses, costs, or damage to personal or real property caused by fire, explosion, flood, freezing, power loss or surges, oil leakage, and premises left unattended. Customer agrees that Company shall not be liable for any incidental, special, or consequential damages incurred by the customer or by third parties, including environmental cleanup costs. 
  11. In the event that the residence is sold, the service plan may remain in effect provided that the new owner continues to purchase fuel oil and heating system service from Densmore Oil Company and is set up on an automatic delivery schedule. 
  12. Amendment and Cancellation: We may amend or change the terms of this agreement at any time. You will be notified of any change in the manner provided by applicable law prior to the effective date of the change. However, if the change is for security purposes, we can implement such change without prior notice. We may suspend or cancel this agreement at any time. Your termination of this agreement will not affect any of our rights or your obligations arising under this agreement prior to termination. 

  1. All service plans are effective April 1–March 31 each year. This Agreement is automatically renewed April 1 each year unless Customer gives Densmore Oil (herein referred to as Company), notice of non-renew. Upon termination, for any reason, there shall be no refund or credits allowed. In the event of sale of property, the Agreement is transferable.
  2. The Company reserves the right to inspect and approve the plumbing system before coverage is issued. Any repairs to bring the system to acceptable conditions will be charged at prevailing rates.
  3. Repairs or Services not covered by the Plans will be performed and charged to the customer at prevailing rates. 
  4. Service plans do not cover the installation or replacement of parts provided by a customer.  
  5. 1-hour minimum for all service calls. An additional after-hours fee will be charged to all service-related calls outside of regular hours. 
  6. All home inspections and testing performed under this Service Plan reflect the condition of the system at the time of service only. A passing inspection does not guarantee future performance, and the Company is not responsible for failures, malfunctions, or issues that occur after the inspection is completed.
  7. This Service Plan does not cover labor or materials to repair any damage to the plumbing system caused by the customer’s neglect, including, but not limited to, failure to have heat set above 55 degrees Fahrenheit, having heating systems turned off completely, improper usage or maintenance of plumbing system. Damage, repairs, or replacement of parts or components, caused by Acts of God, fire, flood, freezing, storm or weather conditions, power loss or surges, water damage are not covered by this plan.
  8. Parts discounts in this Service Plan do not apply to fixtures or fixture upgrades.
  9. As a Service Plan customer, you will have coverage every day during normal business hours, excluding holidays & weekends for emergency service. The Company will not be liable for any damages arising from a delay or failure to provide service due to conditions beyond its control such as Acts of God, unavailability of mechanics or parts, failure or interruption of customer’s electricity, inaccessibility of the system, storms, floods, or other severe weather conditions, or governmental laws or regulations.
  10. Customer agrees to release and hold Company harmless from all claims related to losses, costs, or damage to personal or real property caused by fire, explosion, flood, freezing, power loss or surges, water leaks, and premises left unattended. Customer agrees that Company shall not be liable for any incidental, special or consequential damages incurred by customer or by third parties; including environmental and water clean up.
  11. The customer is responsible for safe access to driveway, and all aspects of the plumbing system. Work areas must be safe and sanitary for personnel. Company reserves the right to refuse to work in unsafe or unsanitary conditions.
  12. Amendment and Cancellation. We may amend or change the terms of this Plan at any time. You will be notified of any change in the manner provided by applicable law prior to the effective date of the change. However, if the change is for security purposes, we can implement such change without prior notice. We may suspend or cancel this Plan at any time. Your termination of this Plan will not affect any of our rights or your obligations arising under this Plan prior to termination.
  13. The Customer agrees to all terms and conditions listed during the term of this Agreement and any renewals thereof. The Customer agrees that in the event there are any changes in coverage in the future, the terms and conditions of this Agreement shall continue to apply.
  14. The Agreement is not an equipment or system replacement plan.
